Bad Check Recovery:
Chamber members,
Some of you asked what fees a bad check writer faced once their case was submitted to the Bad Check Restitution Program.
The check writer is required to:
* Attend an eight-hour intervention class where they will learn about
anger management, managing their finances and accepting responsibility.
The class fee is $165
* Pay the full amount of the check
* Pay a victim fee based on the amount of the check; the fee is $25 per
check for checks up to $100, $30 per check for checks over $100 up to
$250, $35 per check for checks more than $250 up to $500, $40 per check
for checks over $500 up to $1,000 and $50 per check for checks more
than $1,000 to $2,500.
* An administrative fee of $35
An individual refusing to make good on a $50 check, then, would pay a
total of $275 (including the amount of the check, victim fee,
administrative fee and class fee)
It is important to note that only checks received in point
of purchase transactions are eligible, and, in order for your case to
be prosecuted successfully in the event that the check writer does not
comply with the program, you have to have set the basis for a solid
case. Most importantly, you must record the presenters driver's license
number on the check and made notification to the presenter in writing
and given 10 days to make good.
